The following Terms & Conditions apply to our yoga Teacher Trainings in Portugal, whether booked under Transform to Bliss or Joanne Merlini Yoga.

Please read these Terms & Conditions carefully before making a booking. By confirming your booking and paying your deposit or other booking payment, you acknowledge that you have read, understood and agreed to these Terms & Conditions.

In these Terms & Conditions, “Participant”, “you” or “your” means each person booked onto the Teacher Training. “We”, “us” or “our” means Transform to Bliss and/or Joanne Merlini Yoga, as applicable.

These Terms & Conditions, together with the Teacher Training information provided to you at the time of booking and your written booking confirmation, form the basis of the agreement between you and us.

1. BOOKING AND PAYMENT

To make a booking, you must confirm in writing that you wish to attend the Teacher Training and make the required deposit payment.

Your place on the Teacher Training will be confirmed by email once we have received your initial payment.

The price stated for the Teacher Training includes only those elements specifically stated in the Teacher Training information provided to you at the time of booking. This may include tuition, training materials, accommodation, meals and/or other services where expressly stated.

Unless specifically stated as included, the price does not include travel to or from Portugal, flights, travel insurance, personal insurance, visas, transfers, additional activities, treatments, excursions or any other item not expressly included in the Teacher Training price.

Payment may be made by bank transfer or PayPal, or by any other payment method expressly agreed with us.

Payment plans

We understand that Participants may have different financial circumstances and therefore offer the option of agreeing an individual payment plan.

Depending on the circumstances, the Teacher Training fee may be paid in 3 or 4 instalments, including the initial deposit.

The number and dates of payments will be discussed and agreed individually with each Participant at the time of booking and will be confirmed in writing by email.

The agreed payment schedule forms part of the booking agreement. Participants are responsible for ensuring that all agreed payments are made by the relevant due dates.

Regardless of the number of instalments agreed, the full balance for the Teacher Training must be paid no later than 60 days before the first day of the Teacher Training.

For the February/March 2027 payment schedule, the final payment will therefore be due no later than March 2027, depending on the exact start date of the Teacher Training.

If a Participant books the Teacher Training within 60 days of the start date, the full outstanding balance will be payable at the time of booking unless otherwise agreed in writing.

Any additional services or items booked by us on your behalf are payable in full at the time of booking, unless otherwise agreed.

Failure to make an agreed payment by its due date may result in the booking being cancelled, subject to any applicable legal rights and any reasonable opportunity given to the Participant to remedy the missed payment.

Deposit

The deposit amount will be stated in the specific Teacher Training booking information.

The deposit is paid to secure your place on the Teacher Training and, subject to any mandatory rights you may have under applicable law, is non-refundable if you cancel your booking.

If we cancel the Teacher Training, any refund of the deposit will be dealt with in accordance with these Terms & Conditions and applicable law.

Responsibility for payment

The Participant is responsible for ensuring that all payments due under their booking are made on time.

All payments are subject to any rights you may have under applicable mandatory consumer or other laws.

2. YOUR RESPONSIBILITY TO CHECK YOUR BOOKING

Once your booking confirmation has been received, you are responsible for checking all details carefully, including the dates, location, accommodation arrangements, payment schedule and any other information relevant to your booking.

Any errors or discrepancies should be brought to our attention in writing as soon as reasonably possible and, where possible, within 7 days of receiving your booking confirmation.

3. MINIMUM PARTICIPANT NUMBERS & TRAVEL ARRANGEMENTS

The Teacher Training is subject to a minimum number of Participants being reached in order for the training to go ahead.

We reserve the right to cancel or reschedule the Teacher Training if the minimum number of Participants required is not reached.

We will notify Participants as soon as reasonably practicable if it becomes necessary to cancel or reschedule the Teacher Training for this reason.

Where we cancel the Teacher Training because the minimum number of Participants has not been reached, Participants will be offered the applicable refund or alternative arrangement in accordance with these Terms & Conditions and any mandatory rights under applicable law.

We strongly recommend that Participants do not book flights, trains, airport transfers, accommodation outside the Teacher Training arrangements or other non-refundable travel or transport arrangements until we have confirmed in writing that the minimum number of Participants has been reached and the Teacher Training is confirmed to go ahead.

For the 2027 Teacher Training, we expect to confirm whether the minimum number of Participants has been reached by February 2027.

Participants should therefore avoid making non-refundable travel or transport arrangements before receiving written confirmation from us that the Teacher Training is confirmed to proceed.

Participants are responsible for any travel, transport, accommodation or other costs they incur independently of the Teacher Training.

We cannot be responsible for costs arising from flights, transport, accommodation or other arrangements booked independently by a Participant before the Teacher Training has been confirmed to proceed.

Where possible, we recommend booking flexible or refundable travel arrangements.

4. CHANGES OR AMENDMENTS TO YOUR BOOKING

Any request to amend or change your booking must be made in writing.

We will do our best to accommodate reasonable requests, but changes cannot always be guaranteed and may result in additional costs.

Any additional costs arising from a requested change will be advised to you before the change is confirmed.

A change of Participant may only be made with our prior written agreement and may be subject to reasonable administrative costs and/or any additional costs imposed by third-party suppliers.

5. CHANGES TO THE TEACHER TRAINING BY US

We reserve the right to make reasonable changes to the Teacher Training programme, timetable, teachers, accommodation, activities, facilities or other arrangements where necessary.

Where a significant alteration becomes necessary, we will inform you as soon as reasonably practicable and explain the options available to you.

Where applicable under mandatory law, you may have the right to accept the alteration or terminate the booking and receive an appropriate refund.

We will not make changes to the Teacher Training without good reason, and we will endeavour to ensure that the overall nature and standard of the Teacher Training remain consistent with the information provided at the time of booking.

6. CANCELLATION OF THE TEACHER TRAINING BY US

We reserve the right to cancel a Teacher Training where this becomes necessary, including where the minimum number of Participants has not been reached or where circumstances beyond our reasonable control make it impossible or impractical to provide the training.

Where we cancel a Teacher Training, we will inform you as soon as reasonably practicable.

Subject to any mandatory rights you may have under applicable law, where we cancel the Teacher Training you may be offered:

  • a transfer to an alternative Teacher Training of equivalent value; or

  • a refund of payments made to us for the cancelled Teacher Training.

Where applicable, any refund will be limited to amounts actually paid to us and will not include the cost of flights, travel, insurance or other arrangements booked independently by you.

We strongly recommend that you obtain appropriate travel insurance to protect you against such costs.

7. FORCE MAJEURE / UNAVOIDABLE AND EXTRAORDINARY CIRCUMSTANCES

We will not be responsible for failure or delay in providing the Teacher Training to the extent that this is caused by circumstances beyond our reasonable control.

Such circumstances may include, but are not limited to, natural disasters, extreme weather, fire, epidemic or pandemic, war or threat of war, terrorism, civil unrest, governmental action, changes in law, strikes, transport disruption, airport or port closures, or other circumstances which could not reasonably have been anticipated or prevented.

Where mandatory law provides specific rights to Participants in such circumstances, those rights will apply.

Where we are unable to provide the Teacher Training because of such circumstances, we will communicate with Participants as soon as reasonably possible and explain the options available.

8. CANCELLATION BY THE PARTICIPANT

Any cancellation must be received by us in writing.

Our standard cancellation policy is as follows:

More than 90 days before arrival

If you cancel more than 90 days before the first day of the Teacher Training, you will receive a refund of payments made, less the deposit.

Between 90 and 60 days before arrival

If you cancel between 60 and 45 days before the first day of the Teacher Training, you will receive a refund of 50% of the amount paid, excluding the deposit.

Less than 60 days before arrival

If you cancel less than 45 days before the first day of the Teacher Training, the booking will be considered non-refundable.

A failure to attend the Teacher Training without prior written cancellation (“no-show”) will also be considered non-refundable.

The cancellation terms above are subject to any cancellation rights that may apply to you under mandatory applicable law.

We strongly recommend that you take out suitable cancellation and travel insurance at the time of booking.

9. TEACHER TRAINING REQUIREMENTS AND CERTIFICATION

The Teacher Training is an educational and practical training programme. Participation in the training does not, by itself, guarantee certification.

Where certification is offered, Participants must satisfy all requirements communicated to them for the relevant Teacher Training. These may include, where applicable:

  • attendance requirements;

  • completion of required teaching hours;

  • participation in practical sessions;

  • completion of assignments or coursework;

  • successful completion of assessments;

  • satisfactory participation in teaching practice;

  • completion of any required written or practical assessment; and

  • compliance with any applicable training standards or certification requirements.

We reserve the right not to issue a certificate where a Participant has not completed the required elements of the Teacher Training.

Attendance at the Teacher Training does not constitute a guarantee of employment, teaching work, income or any particular professional outcome.

Participants are responsible for ensuring that any qualification or certificate obtained through the Teacher Training meets the requirements of any organisation, insurance provider, employer, yoga school or professional body with which they intend to work.

10. PARTICIPANT HEALTH AND MEDICAL CONDITIONS

Yoga and yoga teacher training involve physical activity and practical teaching.

Participants are responsible for informing us, before the Teacher Training begins, of any medical condition, injury, physical limitation, pregnancy, medication or other circumstance that may affect their ability to participate safely.

Where we request a health or medical questionnaire, it is the Participant's responsibility to provide complete and accurate information.

We will use reasonable efforts to adapt teaching or practices where appropriate and where we are able to do so safely. However, we cannot guarantee that every practice or activity can be adapted to accommodate an individual condition.

Participants must inform the teacher immediately if they experience pain, dizziness, illness, discomfort or any other concern during a practice.

You should seek appropriate medical advice before participating if you have any concern about your physical ability to undertake the training.

You participate in physical practices at your own responsibility and should work within your own capabilities.

11. PARTICIPANT CONDUCT

All Participants are expected to behave respectfully and responsibly towards teachers, staff, other Participants, suppliers, property and members of the local community.

Participants must not engage in behaviour that causes damage, distress, danger, harassment, intimidation, significant disruption or unreasonable annoyance to others.

Illegal activities, violence, threatening behaviour, harassment or significant damage to property will not be tolerated.

Where we reasonably consider a Participant's behaviour to be seriously inappropriate or to present a risk to themselves or others, we reserve the right to require the Participant to leave the Teacher Training.

In such circumstances, and subject to applicable law, the Participant may not be entitled to a refund or compensation for the unused portion of the Teacher Training.

The Participant is responsible for the cost of repairing or replacing property damaged by them, other than reasonable wear and tear.

12. INSURANCE

We strongly recommend that Participants obtain appropriate travel and personal insurance at the time of booking.

Insurance should, where appropriate, cover cancellation, travel disruption, medical expenses, personal belongings, personal liability and repatriation.

Participants should check that their insurance covers participation in yoga and yoga teacher training activities.

We do not provide travel, medical, cancellation or personal belongings insurance to Participants.

Participants are responsible for ensuring that they have appropriate insurance for their own circumstances.

Passport, visa and immigration requirements are the Participant's responsibility. Participants must ensure that they have all necessary travel documentation and permissions required to enter and remain in Portugal.

13. TRAVEL, VISAS AND DOCUMENTATION

Participants are responsible for arranging and paying for their own travel to and from Portugal unless travel is expressly included in the Teacher Training package.

Depending on your nationality and country of residence, you may require a visa or other permission to enter Portugal.

It is your responsibility to check the relevant requirements before booking flights or making other travel arrangements.

We do not provide immigration or visa advice and cannot be responsible for a Participant being unable to travel because they do not have the required documentation.

14. THIRD-PARTY SERVICES

Where we arrange additional services on your behalf, such as airport transfers, excursions, restaurant bookings, treatments, sauna/steam facilities or other activities, these may be provided by independent third-party suppliers.

Where such services are not part of the Teacher Training package provided by us, the terms and conditions of the relevant supplier may also apply.

We will use reasonable care when selecting and arranging third-party services.

15. TRANSFER SERVICE

Where we offer or arrange a transfer service, details of the available service, times and costs will be provided separately.

Transfer times may be affected by flight delays, traffic, weather, road conditions or other circumstances beyond our reasonable control.

We will make reasonable efforts to assist Participants with transfer arrangements but cannot guarantee that a particular transfer time will always be available.

16. WEATHER AND CHANGES TO ACTIVITIES

Weather conditions may affect the Teacher Training programme or any outdoor activities included within it.

Where we reasonably consider that weather or other environmental conditions make an activity unsafe or unsuitable, we may change, postpone, relocate or cancel that activity.

We will endeavour to provide a suitable alternative where reasonably possible.

The safety of Participants, teachers and staff will always take priority.

17. FOOD, ALLERGIES AND DIETARY REQUIREMENTS

Participants must inform us in advance of any food allergies, intolerances or dietary requirements through the relevant health or booking questionnaire.

We will use reasonable efforts to accommodate dietary requirements where these have been communicated to us in sufficient time.

However, where food is prepared or supplied by third-party caterers, restaurants or venues, we cannot guarantee that cross-contamination or accidental exposure will not occur.

Participants must personally inform the relevant restaurant, caterer, venue or food provider of any serious allergy or intolerance before consuming food.

If you have a severe or potentially life-threatening allergy, you should discuss your requirements with us before booking so that we can determine whether we are able to safely accommodate them.

18. LIABILITY

We will provide the Teacher Training with reasonable care and skill.

Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited under applicable law.

Subject to this, we will not be responsible for loss, damage, injury, delay, expense or inconvenience caused by circumstances outside our reasonable control or by the acts or omissions of the Participant or an independent third party, where we are not legally responsible for those acts or omissions.

Participants remain responsible for their own personal belongings and valuables.

We recommend that Participants do not bring valuable or irreplaceable items to the Teacher Training..

19. COMPLAINTS PROCEDURE

We want every Participant to have a positive experience.

If you experience a problem during the Teacher Training, please tell us as soon as reasonably possible so that we have an opportunity to investigate and, where possible, resolve the issue while you are still attending the training.

Complaints should initially be raised with the Teacher Training team or Joanne Merlini.

If the matter cannot be resolved during the Teacher Training, please put your complaint in writing as soon as reasonably possible after the event.

20. WEBSITE AND TRAINING INFORMATION

We take reasonable care to ensure that information provided on our website, social media, brochures and other promotional material is accurate at the time it is published.

However, photographs, descriptions, timetables, teachers, venues, activities and other details may occasionally change.

The specific information provided to you at the time of booking and your booking confirmation will take precedence where applicable.

21. PRIVACY

We respect your privacy and will process your personal information in accordance with applicable data protection legislation and our Privacy Policy.

We do not share Participant information with third parties except where necessary to provide or administer the services you have booked, where you have given consent, or where we are legally required or permitted to do so.

22. GOVERNING LAW AND JURISDICTION

These Terms & Conditions and the agreement between you and us will be governed by the law applicable to the booking and services provided, subject to any mandatory consumer protection rights that apply to you.

Nothing in these Terms & Conditions is intended to deprive a consumer of any mandatory rights or protections available under the law that applies to their booking.

23. ACCEPTANCE OF THESE TERMS & CONDITIONS

By confirming your booking and making the required booking payment, you confirm that you have read and understood these Terms & Conditions and agree to be bound by them.

These Terms & Conditions should be read together with the specific information provided for your Teacher Training, your booking confirmation and any other documents expressly incorporated into your booking.
